These Terms of Use ("Terms") govern your access to and use of the website, mobile applications, and Software-as-a-Service (SaaS) Electronic Medical Records (EMR) platform operated by Sanjeevani Software ("we", "us", or "our"). By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility, Scope, and Registration

Eligibility: You must be at least 18 years of age and competent to contract under Indian law.

Professional Registration: Access to professional modules is strictly restricted to practitioners holding a valid, active registration with the relevant homeopathic or medical regulatory authority in their jurisdiction. You must maintain this validity throughout your use of our platform.

Account Credentials: You are solely responsible for safeguarding your login credentials and tracking all operational activities under your multi-tenant clinic tenant.

2. Clinical and Medical Software Disclaimer

Sanjeevani Software is purely a decision-support and clinic management tool. It does not practice medicine and does not provide professional medical advice, diagnosis, or treatment.

All final clinical judgments — including remedy selection, potency, dosage (posology), miasm analysis, and case evaluation — remain the sole and exclusive responsibility of the treating healthcare practitioner. Any automated rubric suggestions or analysis features are strictly advisory.

3. Patient Data Ownership and Authorizations

You explicitly retain all intellectual property rights and ownership over the clinical patient records you input. You act as the legal Data Fiduciary/Controller, and we act as your Data Processor.

You grant us a limited, royalty-free license to host, store, back up, and process your data strictly to operate and maintain the platform on your behalf.

4. Prohibited Uses

You agree not to attempt to reverse-engineer, decompile, copy, scrape, or circumvent the platform's technical rate limits or access controls.

You must not upload any files containing malware, destructive code, or content that violates public or regulatory laws.

5. Limitation of Liability and Indemnity

To the maximum extent permitted by law, Sanjeevani Software shall not be liable for any indirect, incidental, or consequential clinical or financial damages. Our total aggregate liability for any operational claims shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the event.

You agree to indemnify and hold harmless Sanjeevani Software from any third-party claims arising from your clinical prescriptions or your failure to secure valid patient consents.

6. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute that cannot be resolved amicably via good-faith discussions within 30 days shall be referred to binding arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Mumbai, Maharashtra, and the language shall be English.
